Mafia, for the Cassation the repentance of Brusca is not completed

Giovanni Brusca, the killer of the Capaci massacre and the murder of little Giuseppe Di Matteo cannot go to the domiciliary: his "criminal caliber" and the "seriousness of the crimes committed" do not allow the granting of this benefit, for which it is necessary that there be a "complete repentance" and the "civil repentance", elements that must be deepened and verified in time. This is explained by the First Criminal Section of the Cassation in the reasons for the sentence with which, on October 7th, it rejected the request for domiciliation to the justice collaborator and the boss of Cosa Nostra, who is serving 30 years in prison in Rebibbia, with the end of sentence in 2022 Brusca asked for access to house arrest, a request already rejected by the Rome surveillance court.But it is precisely the "criminal caliber that he has demonstrated in his life to possess" that leads us to consider "not yet acquired the definite and definitive proof of his repentance, but only of an uncompleted repentance, also considering the uncertainty of the completion of his journey of repentance".
With the sentence filed today, the judges of Piazza Cavour share the conclusions of the Court of Surveillance of the capital, noting "the inexistence of evidence of effective complete repentance", and that "the effort of Brusca in expressing his civil repentance and its intent to reconcile with the families of the victims and of society as a whole must be deepened and verified over time ". Moreover, we read again in the sentence, "in the face of the undoubted manifestations of repentance" of Giovanni Brusca, the "reparative initiatives" undertaken by him are not "yet the expression of his complete repentance", but that this path "is currently only positively started. "Therefore, the "positive treatment path carried out by Brusca", continues the Supreme Court, "his 'good' level of critical review of the past and the collaborative behavior he held" are not "sufficient" indices "in relation to his" undisputed criminal depth ". In the ruling of the Cassation it is recalled that the "criminal history of Brusca is undoubtedly unique and unprecedented", with "more than a hundred murders committed, in the most bloody manner, in some cases without selecting the victims, but affecting children alone to carry out transversal vendettas, mafia bosses, servants of the State, private citizens fallen in the activity of the stragista ", and like," among so many 'men of honor', nobody had realized an equal bloodthirsty path, manifesting unusual violence and absolute disregard for the value of human life ".
