The Privacy Guarantor to the Government: "Rewrite the fight against evasion"

There maneuver now it has to be rewritten. At least for the part that concerns the fight against tax evasion and the tightening of controls and checks to monitor the expenses and movements that concern individual tax payers. In short, the violation of privacy which concerns all the personal data that in one fell swoop will end up under the eyes of the tax authorities could be one of the obstacles on the road to this new "fiscal police state" that the Giallorossi are preparing. After the first warnings on the other instruments used by the tax authorities and on the databases that make available to those who control taxpayers' confidential data, the Privacy Guarantor has decided to ask the executive formally to rewrite (almost from the beginning) the Article 86 of the Budget Law. It is precisely in this article that they are given hands-free for a loose tax offensive. And so the Guarantor has already provided the executive with the three "errors" to be "corrected" in the Budget Law, such as the list of treatments based on which the right to access the documents is limited, but also the same list of all the rights that are limited and above all, as you recall Italy today, the correction exercise by the tax payer.

All critical points to clarify that could put at risk the same fight against evasion that the executive has scheduled with the maneuver. In fact, the Guarantor requests the inclusion of "appropriate measures to protect the rights and freedoms of the persons concerned". Even on the anonymity "promised" by the maneuver in examining the data of tax payers, serious doubts are expressed. The use of a code or a pseudonym instead of the tax code only changes the nature of the label, leaving the taxpayer clearly identifiable. The findings of the Guarantor are then increasingly clear and precise: "Foreclosing (or even limiting) the exercise, directly by the interested parties, of the right to rectify inaccurate data, risks hindering the detection of errors in the prodromal assessments to tax audits, which risk determining a false representation of the ability to pay, deviating therefore undermining the effectiveness of the action to combat tax evasion"But be careful in this story there is a detail that should not be underestimated. The maneuver set up in this way could not enter into force. The reason is explained by the Guarantor himself: these rules go against the European discipline on privacy, making it completely illegitimate the rule that goes to define the fight against tax evasion and that of fiscal controls: in short, the maneuver and the fiscal pressing wanted by the Giallors could be blown up for a non-secondary problem: that of the right to privacy.
