ROME – The new Rai competition for journalists – 90 seats available to the regional newspaper, 3722 candidates – ends up being brought to the attention of the State Television Board of Directors, which meets today. Riccardo Lagana, councilor elected by the RAI employees, writes to the company president Foa, to the managing director Salini, to the general director Matassino, to the other board members.In his letter, Lagana refers to the news that "the college of the lawyers of Rai" has been protagonist of an important forgetfulness in Court. Rai, in practice, "would not have appeared in court against one of the two appeals presented to the labor judge to block the new competition". Therefore, before the labor judge Anna Maria Lionetti, public television organized a half-way defense.
Against an appeal, he exposed his defense. Against a second appeal, he presented no defense because he did not know it existed. The state television, for this second appeal, is now contumacious. The situation certainly does not imply an automatic defeat of the RAI. The labor judge remains free to reject the second appeal by giving the green light to the new competition. Of course, he will assess the case in the absence of a Viale Mazzini defensive line. And it's not little.Precisely for this reason, Lagana now wants to know if "the defensive college was also composed of internal representatives of the Legal Affairs Department and the Human Resources Department"; and what are the "reasons why you would have incurred failure to appear in court".
Both appeals were presented by the "Public Information Committee", created by over 100 journalists who were eligible for the previous Rai competition (the 2015 competition). In the first appeal, they ask to be hired before the new competition is celebrated with a right of way.
The lawyer for the winners of the 2015 competition, Enzo Iacovino, calls into question the 2017 Financial law (in particular paragraph 1096). This paragraph 1096 authorizes Viale Mazzini to enter "figures at the lowest salary level, drawing first and foremost from the appropriate personnel included in the 2013 and 2015 rankings of recognized professional journalists".

Rai replies that the law allows recruitment, but does not oblige recruitment. State television therefore feels free from constraints and authorized to announce a new competition. Rai also considers that the 2015 ranking has now lapsed. Instead, the winners of the 2015 competition recall that the financial law allows recruitment "in a virtuous perspective of medium to long-term savings". With this in mind, if you need to save money, the old 2015 ranking should stay alive. Conversely it would be a waste to organize a new competition by spending – they say – 2 million public money.
The winners of the 2015 competition presented a second appeal to contest the announcement of the new competition, which would be flawed. The new announcement, for example, allows participation only by professional journalists, while it excludes journalists registered in a different register (that of publicists). The second appeal also challenges the fact that Rai does not aim to create a national ranking of new winners, rather.
He has announced places in the various regional offices and the candidates have had to indicate for which region they compete. In this way, a less good candidate could win in Basilicata than a defeated person in Sicily. To these objections of the second appeal, Rai was unable to reply precisely because it was a default.
Both appeals were presented pursuant to Article 700 of the Code of Civil Procedure. Therefore they are precautionary and urgent. If the labor judge were to accept the second one, then the Rai could come back into the game and organize its defense, during the appeal.
