The complaint of the German Consumer Protection Foundation (SKS) concerned a video of Roger Federer and a publication of Xenia Tchoumitcheva on the platform Instagram, announced the foundation in a statement Friday. According to SKS, these two publications were not identified as advertising.
In both cases, the commission does not deny the existence of a commercial communication, SKS emphasizes. However, it considers that for the "average recipient" this is clearly recognizable as advertising.
Ms. Tchoumitcheva's entire account, on which she highlights branded jewelery, is of a purely commercial nature. Individual publications do not need to be labeled as advertising, the committee said.
Two sports pinned
In July, the Commission for Loyalty approved two consumer protection complaints against elite athletes. She found snowboarder Iouri Podladtchikov and cyclist Jolanda Neff had mismanaged hidden ads on Instagram.
In his publication, the snowboarder Yuri Podladtchikov is photographed in the entrance of a clothing store. Cyclist Jolanda Neff posted an insert from a credit card company.
According to the judgments of the commission for loyalty, this is not allowed: a person who is sponsored and receives fees or benefits in kind from a service provider must open them transparently. This was not done in both cases.
