The legal battle between Airbus and Boeing before the World Trade Organization (WTO) began 15 years ago when Washington declared dead a 1992 US-European agreement governing subsidies in the aviation sector.
The United States fired first in 2004, accusing the United Kingdom, France, Germany and Spain of granting illegal subsidies to support the production of a series of Airbus products.
A year later, the EU claimed that Boeing received $ 19.1 billion in prohibited subsidies between 1989 and 2006 from various branches of the US government.
The two cases then became entangled in a legal quagmire, with each party partially successful after a long series of appeals and counter-appeals.
Under WTO rules, the EU and the US each have the right to sanction the other. According to Malmström, Washington could impose customs duties the week of 13 October.
The EU should have the opportunity to impose similar duties on the US only in about six months.
Washington has demanded the right to collect customs duties worth $ 11.2 billion, while Brussels claims $ 12 billion as a penalty.
The Airbus-Boeing conflict is just one of many problems fueling transatlantic tensions, which have escalated rapidly since US President Donald Trump took office in 2017.
