Defense of Jensen Medina tries to establish that testimony of Arellys Mercado's partner is inconsistent

Earlier, with a dramatic account, Howie Garcia declared in room 305 of the Fajardo court to have seen Jensen Medina Cardona kill her on the night of August 18 in Villa Marina, in the said municipality.
The Mercado Ríos couple was the first witness presented by the Public Prosecutor's Office on the third day of a preliminary hearing against Medina Cardona to prove the charges for first degree murder and violation of the Weapons Law imputed to him. During the live broadcast of the process his face was never shown, only his voice was heard at the request of the prosecution.
Prosecutor Eduardo Beale was in charge of the interrogation of the sentimental partner who questioned how the day passed from the arrival at the navy, at noon, until they returned from the islands of Icaco and Palomino to dock their boat, in hours of the night.

He said that, initially, a friend of Mercado Ríos – whom he identified as Joan – did not know they had found him, so he told Medina Cardona that they did not have him.
But, hearing the discussion, Howie Garcia said he realized what it was and handed it over. He assured, in turn, that Medina Cardona received him more calmly.

He added, however, that Medina Cardona's companion shook him, indicating that they wanted to steal his phone. Then, according to the witness, he turns to the friend of Mercado Ríos and claims that they did.
The witness verbally and physically related the moment in which the accused approached "altered" to claim the phone and despite the fact that both Arellys and his companions asked him to leave because he had already handed him the cell phone, he allegedly found the trigger and he shot Mercado Ríos in the neck.
"Arellys approaches him calmly and tells him that he already has the phone and that he leaves. But he replies: 'You do not know me, you do not know me'; and the woman who accompanied him stirred him saying: ' You saw him wanted to steal, they wanted to steal ''Howie García detailed.

He said that at that moment he heard a "horrible" noise of metals, implying that Medina Cardona had loaded the weapon.
Then, as part of the graphic dramatization he offered in the courtroom, Howie Garcia got off the witness bench and made a gesture like throwing a fist at the prosecutor's neck, supposedly, imitating the way Medina Cardona did it with Mercado Rivers.
However, instead of hitting him with his hand on his neck, he said that in his hand he had a gun with which he shot his partner.

Howie García said that after the shot he saw that Medina Cardona stared, until the woman who accompanied him found him shouting: "Let's go, let's go, let's go!"

I have nothing to defend myself ”, Howie García said, who was almost breathless when the prosecutor asked him what happened after the shooting and Judge María T. Rivera Corujo, who did not show his image in the live broadcast, had to recess for several minutes.

Once the process was resumed, after the break, prosecutor Eduardo Beale showed the witness photographs to compare with the dramatization he had done, the drawing and the narration.

Medina Cardona remains in prison after a $ 1.15 million bond was imposed, which he could not lend. The defense submitted a motion to the court to lower its bail, but Judge Glenn Velázquez, who presided over the modification hearing, declared the petition not in place.
