After years of using this model, which allows an operator to use the networks of others in exchange for a payment for benefit, Avantel maintains that it has no outstanding debt with Claro, Tigo and Telefónica Movistar. However, the three operators argue that since November 2018, the date on which the RAN preferential rate for Avantel changed, it does not pay them the updated cost.

"Since November 2018, Avantel has refused to comply with current regulatory measures, once the differential tariff treatment established by the Communications Regulation Commission (CRC) for its first five years as a mobile operator has ended, this has implied the non-payment of the corresponding values ​​for the use of the Movistar network for voice and data service", argues Telefónica Movistar, who said that he initiated an action before the Superintendence of Industry and Commerce (SIC)" for unfair competition. "

The operator affirms that the SIC has already issued a precautionary measure ordering Avantel to pay the regulated values, however, the entity has refused to comment. "For these same facts, Mintic charged Avantel charges for regulatory violation," said Telefónica.

For his part, Claro explained: "Since November of last year, Avantel has
refused to pay the operator fee established for the use that its users make of other networks where this operator does not have coverage
, known as the National Automatic Roaming service. (…) We urge Avantel to fulfill its obligations to guarantee the best service to its customers ".

Likewise, Tigo indicated that on September 18, the CRC "settled the conflict between Tigo and Avantel by establishing that since November 14, 2018, the RAN rates that Avantel must pay to Tigo are those that apply to all telecommunications operators and not the rates of incoming operators, as stated by Avantel. "

The operator maintains that currently, the delinquent debt for the RAN service amounts to more than 29 billion pesos.

But nevertheless, Avantel, which was pronounced on Wednesday 18, states that "there is no past due debt with any operator."

"What happens is that we are in a dispute between operators on what should be the applicable standard to calculate the rate of RAN," says Avantel.
