The agreement, subject to scrutiny by the Competition and Market Authority, was revised in April 2019, no longer providing for the sale of the R2 platform. However, the Antitrust Authority, considering that the transaction would “have generated anti-competitive effects” decided to impose a ban on Sky “to stipulate exclusives for audiovisual content and linear channels for internet platforms in Italy”.
Now the Tar’s decision, which overturned the situation in favor of Sky assisted by the Cleary Gottlieb law firm with a team led by lawyers Beretta and D’Ostuni.
This result represents an important point marked in view of the rights auction for the Serie A 2021-24. Today, in fact, Sky and Dazn (which like Timvision, Netflix, Amazon uses that Internet platform subject to the Antitrust measure), the Serie A matches are shared: 7 in Sky and 3 in Dazn every week exclusively. With the prohibition established by Antitrust this scheme would no longer be possible.
