Coronavirus, flights and tickets canceled: here's how to get a refund

Flights canceled, travel packages booked but not available due to travel restrictions coronavirus. The Consulcesi legal protection network is handling many requests from disoriented citizens in recent days and has drawn up a first series of useful tips. With the publication in the Official Journal (see art. 28 DL n. 9/2020), the Government has introduced urgent measures in favor of those who have purchased tickets and travel packages, both privately and with agencies, which they have not been able to use for the emergency state, better described today by the last Dpcm.

The following can be reimbursed for the cost incurred: 1) those who have been placed in quarantine or, in any case, are resident or domiciled in the Municipalities that fall within the “red zone”, or in any case subject to limitations 2) those, both private and companies, who have planned any type of trip or trip, with departure or arrival in the areas subject to limitations 3) those who, having booked trips or trips to participate in competitions, events or shows of any kind, have verified the cancellation with a measure taken by the authorities competent 4) those who, having purchased travel tickets to destinations abroad in Italy, have ascertained that landing in these areas has been prohibited by a measure taken by local authorities due to the epidemic.

If the conditions are met, the citizen must forward a communication to the travel agency or to the airline company, in which he requests a refund of the cost incurred, attaching a copy of the travel document and, if it is a canceled event, documents that certify their expected participation. This communication must be submitted within 30 days: from the end of the imposed ban (quarantine, limitation); from the cancellation, suspension or postponement of the scheduled event; from the date scheduled for departure to a country where an entry ban has been imposed.

Within the following 15 days from the actual receipt of the request, the recipient of the application must refund the amount paid, or issue a voucher of the same amount, which must be used within one year of the issue. Identical measures are foreseen for those who should renounce a tourist package. In these cases, users can legitimately exercise the right of withdrawal, asking for the refund of the price already paid, with the right for the organizer to proceed with the refund, offer a replacement package of equal or greater value or, alternatively, issue a voucher annual for the same amount.
