Parental leave, ok even if the other parent is in smart working

The extraordinary parental leave to take care of the children at home due to the closure of the schools for the coronavirus emergency (THE UPDATES – SPECIAL – THE SITUATION IN ITALY: MAP) can also be asked if one of the two parents is in smart working and therefore at work from home. This is what emerges from the INPS circular on parental leave provided for by the decree of 17 March. On the other hand, leave cannot be requested if the other parent is unemployed or has income support (such as Naspi or citizenship income).

15 days, even divisible, at 50% of the salary

The leave introduced by the decree of 17 March for the care of minors during the school closing period – reminded INPS – is 15 days also divisible, is compensated for 50% of the salary and covered by figurative contribution and can be used alternately by the two parents. It can be used by parents, employees of the private sector, by workers enrolled in separate management, by self-employed workers enrolled in INPS and by public employees. It can only be applied for children up to 12 years of age if the other parent works and is neither unemployed nor a recipient of income support. It may therefore be asked if the other parent is smart working and working from home.

The bonus as an alternative to leave

As an alternative to leave, parents have been able to request a bonus for the purchase of babysitting services for a limit of 600 euros. Furthermore, an increase in the number of paid leave days of law 104 (three per month) was foreseen, by 12 days as a whole that can be used in the months of March and April 2020. Finally, the possibility of accessing leave was provided, without remuneration and without contribution (with request only to the employer) also for those workers with children between 12 and 16 years while for those with children in serious situations it will be possible to have the compensated leave even over 12 years of age provided they attend school or day care center.

For those who have already used ordinary leave

Pending the adaptation of the IT procedures for submitting the application – explains INPS – as for example in the case in which the worker has already fully used ordinary parental leave, employers must allow the use of Covid-19 leave and pay the relative allowance, without prejudice to the burden on the parents, as soon as the adaptation of the IT procedures is completed, to submit the application to the Institute. The request may also relate to periods of abstention prior to the date of submission of the same, provided that they are not prior to the date of March 5, 2020.
