Yara murder, Bossetti's defense can examine the findings of the investigation

There is a request to revise the trial of Massimo Bossetti, who was definitively sentenced to life imprisonment for the murder of 13-year-old Yara Gambirasio. And the Bergamo Assize Court authorized the defense of Bossetti to examine all the findings of investigation, the clothes the girl from Brembate wore in the province of Bergamo when she disappeared on 26 November 2010. Among the items to be examined there are briefs, leggings, shoes, jacket and samples on the genetic trace.In the petition presented by the defenders Claudio Salvagni and Paolo Camporini, it is underlined that "to date the defense has not been allowed any access to the finds", starting from the DNA samples "still available and stored at the San Raffaele hospital in Milan" . Items returned to the limelight recently. The defensive activity aims to resolve the "different anomalies" that emerged in the process starting from the genetic trace, which has always been the heart of the debate. A mixed trace, perhaps blood, of Yara and Unknown 1 in which the nuclear DNA matches that of Bossetti, but not the mitochondrial DNA (indicates the maternal line). The biological trace is the granitic test for accusation and judges.
The absence of Bossetti's mitochondrial DNA does not invalidate the result: it is only nuclear DNA that has forensic value. "That DNA is not his, there was no match, he has so many problems – 261 – which are more his faults than his markers", has always been the thesis of the lawyers. Today's court decision allows the defense to have access for the first time to elements of the crime scene, including DVDs containing photographic images of findings made by Ris, but above all to analyze DNA and do it with new technologies.With the use of new methods "it is fundamentally possible – we read in the petition presented by the defenders – to make further withdrawals, from which not only to verify what has already emerged, but also to obtain further information potentially useful also for investigative purposes and search for characteristics peculiar as the original ancestral and the phenotype of the unknown DNA "

The new exams that the defense will ask to do with an evidentiary accident, so in the presence of the consultants of all the parties, could give a "scientifically sustainable" answer to the doubts of the defenders. The wish of the lawyers is to have on the biological trace "a more complete and reliable investigation", from which to start to ask for the reopening of the case of Yara, hit several times and found lifeless on February 26, 2011 in a field of Chignolo d'Isola, for which Bossetti is serving a life sentence in the Bollate prison in Milan.
