Riace, the Locri court declares the Trifoli League mayor lapsed

REGGIO CALABRIA. He had promised an administration devoted to transparency and legality, but he himself could not even participate in the elections. The mayor of Riace, Antonio Trifoli, was not eligible so he must be declared forfeited. The Tribunal of Locri puts a tombstone on the administrative experience of Trifoli and of his majority to the Northern League, which on May 26th established itself promising to bury Mimmo Lucano's "Riace model".

More than a month after the hearing, the judges accepted the appeals presented by Maria Spanò, a former candidate for mayor of the “Il cielo sopra Riace” list and by a group of citizens who, based on what was reported by the Republic a few months ago, disputed the legitimacy of the election of Trifoli.

Reason? As a temporary employee of the Municipality he had no right to access unpaid leave for electoral reasons. Furthermore, as a traffic policeman according to Tuel, he could not apply in the Municipality where he carried out his duties. Arguments espoused by the judges of Locri who, with a sentence of 12 pages, sent back Trifoli's justifications to the sender.

Although he had signed a contract with the Riace administration, both in public and in court the mayor has always tried to assert his status as a former Lsu-Lpu, therefore a worker in charge of the Region. Theories that have not convinced the judges, who in their sentence write: "The watershed between the legal status of the L.S.U. worker is clear and L.P.U. and the one who, within the framework of this employment procedure, is stabilized with a fixed-term contract, such as the one stipulated between the Municipality of Riace and Mr. Trifoli ”. Translation, it was in all respects a fixed-term employee of the Municipality of Riace and therefore ineligible, therefore to be declared lapsed.

It is not an order that is immediately enforceable, its effectiveness remains suspended until the appeal is called. However, the Prefecture also appeared in court against Trifoli, with an opinion from the Interior Ministry that called it incurable, and now it could decide not to wait until the time of justice and proceed immediately to the commissioner of Riace. Also because Trifoli is not the only one of the majority to have been accompanied to the door of the administration that claimed to govern. A few months ago, the local secretary of "Noi con Salvini", Claudio Falchi, was quick to resign, officially "for family reasons", the same day that the prefecture declared him ineligible because of a conviction for bankruptcy remedied in 2003.

In the country the opposition, "Lucanian" and not, celebrates. "Weren't those of transparency and legality?" He points out more than one. But Mimmo Lucano does not let himself be swept away: "I accepted the political outcome of the elections, so I didn't get interested in these legal events. The real battle for me remains in terms of building a concrete alternative in society. From what we have seen in recent months, their approach is diametrically opposed to ours ".
