A young black woman killed at her home in Texas by a white policeman during a mock check, reportedly pointed a gun at the officer fearing an intrusion, according to investigative documents released Tuesday.

Atatiana Jefferson, 28, was fatally injured in the night from Friday to Saturday by Aaron Dean, an officer called to the home of the young woman in Fort Worth, near Dallas. A neighbor had worried that the front door was open and the policeman outside shot through the window of a home window.

The case revived the debate on police violence and discrimination against the African-American minority.

Aaron Dean was charged with murder Monday after he resigned from police and was released on bail Tuesday.

According to the criminal prosecution, citing Atatiana Jefferson's 8-year-old nephew, the victim was playing a video game with the boy when she heard a suspicious sound in her garden. She allegedly pulled a handgun out of her purse and pointed it at the window before being hit.

The document indicates that the officer did not identify himself as such during the check, but does not say whether he saw a weapon.

Local police chief Ed Kraus said at a press briefing on Tuesday that it seemed "normal for her to have a weapon if she felt threatened or someone in her garden" .

The lawyer for the victim's family, Lee Merritt, seemed to confirm the boy's testimony.

"It's quite fitting that Ms. Jefferson had a weapon" if she thought "of someone lurking in his garden at 2:00 am," he told reporters.

The lawyer stated that the weapon had been legally purchased and that the victim had a license.

Lee Merritt also accused the local police of building a defense strategy for the accused officer by suggesting that he would have pointed his gun at the window.

But the chief of police assured that there would be no right. "There is absolutely no excuse for this act and the responsible person will be held accountable," he said.

The case comes two weeks after a white policewoman in Dallas was sentenced to ten years in prison, killing a black neighbor and saying she was mistaken.
