The Rome prosecutor asked for the filing of the lawsuit filed by Fedez and Chiara Ferragni versus Daniela Martani, former Alitalia pasionaria and competitor of Grande Fratello 2009. Su Twitter, Martani had defined the two "idiotic inflated balloons". According to the prosecutor, as reported by the Corriere della Sera, the social media are not authoritative and enjoy "little consideration and credibility".

The libel lawsuit

The attack of Daniela Martani dates back to a year ago, when the "Ferragnez" had just finished the birthday party a surprise that Chiara Ferragni had organized for Fedez in a supermarket and was criticized for wasting food launched as bullets.

At 1.50 on October 23, 2018, Martani wrote on Twitter: "I've been telling you for years that I am two idiotic inflated balloons disrespectful of the lives of people and animals. They don't know what to invent to talk about them. Making a party at home was too normal otherwise those who like it ".

Thus Fedez, through lawyers Gabriele Minniti and Andrea Pietrolucci, had sued the former hostess for defamation believing that he had "abundantly exceeded the limits of the right of criticism".

The prosecutor's decision

Asking the judge for preliminary investigations to dismiss the case, the prosecutor Caterina Sgrò stated that "on social media it happens that an unlimited number of people, belonging to all social classes and cultural levels", possesses "the immediate need" to "vent their anger and frustration".

According to the prosecutor, therefore, users of social networks would write "out of any control" anything, even using "scurrilous terms, denigrators, etc., which in the abstract they can supplement the crime of defamation, but in practice they are free of offensiveness ".

The motivation is that, because of the context in which the offenses are made, these “enjoy low regard and credibility"And" are not suitable to damage the reputation of others ".

The opinion of the lawyers

In opposition to the filing, Fedez's lawyers have instead specified that "the diffusion of a defamatory message integrates a hypothesis of aggravated defamation"Precisely because it can reach an unlimited number of people.

If the request for archiving were accepted, "we would risk transforming social networks into a real free zone in which everything is granted", risking "barbarizing the customs and habits of people".
